1. INTRODUCTION & ACCEPTANCE OF TERMS
This website is operated by My Gaea Organics ("Company," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your access to and use of mygaeaorganics.com (the "Site") and all purchases made through the Site.
By accessing the Site or completing a purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms and all policies incorporated by reference, including our Privacy Policy, Shipping Policy, and Return & Refund Policy.
If you do not agree, you must not use the Site or purchase our products.
2. ELIGIBILITY
You must be at least 18 years old and have legal capacity to enter into a binding agreement to use this Site or purchase products.
By placing an order, you represent and warrant that you are at least 18 years of age. We reserve the right to request proof of age and refuse service to anyone who cannot provide adequate verification.
We do not knowingly sell to minors. If we learn that a minor has made a purchase, we will cancel the order and issue a refund.
3. BUSINESS MODEL & PRODUCT DISCLOSURE
My Gaea Organics is a small, family-owned business producing handcrafted, small-batch skincare products using natural and organic ingredients.
Because of this:

• Such variations are normal and do not constitute defects
By purchasing our products, you explicitly acknowledge and accept that:
• Natural and organic skincare products inherently vary between batches
• Variations in color, scent, texture, and consistency are normal characteristics of handcrafted products
• Shelf life may be shorter than mass-produced synthetic alternatives
• Products must be stored properly (away from heat, direct sunlight, and moisture)
• Such variations do not constitute defects, damages, or grounds for return or refund
4. INTELLECTUAL PROPERTY RIGHTS
All content on this website, including but not limited to text, graphics, logos, images, product descriptions, formulations, photographs, videos, designs, and software, is the exclusive property of My Gaea Organics and is protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material from this Site without our prior written consent, except for:
• Temporary storage in RAM incidental to accessing and viewing the Site
• Single copies for personal, non-commercial use only
Unauthorized use may result in legal action, injunctive relief, and damages.
5. ORDERS, PRICING & PAYMENT SECURITY
All prices are subject to change without notice.
We reserve the right to refuse or cancel any order, including those suspected of fraud, abuse, resale, or policy circumvention.
Order Confirmation
Receipt of an order confirmation email does not constitute our acceptance of your order. We reserve the right to accept or decline your order for any reason, including product availability, errors in product or pricing information, or suspected fraud.
Order Limits
We reserve the right to limit quantities purchased per person, household, or order. This includes orders placed under the same account, payment method, billing address, or shipping address.
Payment Security
• We do not store complete credit card information on our servers
• Payments are processed through PCI-compliant third-party payment processors
• By submitting payment information, you authorize us to charge your payment method for all purchases
Pricing Errors
We reserve the right to cancel orders placed due to pricing, inventory, or product description errors, even after order confirmation, with a full refund issued.
Taxes
Prices do not include applicable sales tax. Sales tax will be calculated and added at checkout based on your shipping address.
Chargebacks
If you initiate a chargeback or payment dispute without first contacting us to resolve the issue, we reserve the right to:

All sales are final, except as expressly stated in our Return & Refund Policy.
We do not accept returns or refunds based on preference, dissatisfaction, or delayed delivery.

Mandatory Patch Test
You acknowledge and agree that you must perform a patch test on a small area of skin at least 24–48 hours before full application of any new product.

You expressly assume all risk of adverse reactions. By purchasing, you acknowledge that:

• You do not have known allergies to listed ingredients
• You will perform a patch test before full use
• You will discontinue use immediately if adverse reactions occur
• You release My Gaea Organics from liability for reactions caused by failure to review ingredients or perform patch testing

• Botanical extracts
• Bee products (honey, beeswax, propolis)

As a small-batch facility, we cannot guarantee that products are free from cross-contamination with allergens, even if not listed in a specific product's ingredients.
Severe Allergies

In such events, we may cancel orders with full refund and will not be liable for any consequential damages.
17. DISCLAIMER OF WARRANTIES
The Site and all products are provided "AS IS" and "AS AVAILABLE."
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
18. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
• Our total aggregate liability for all claims arising from your relationship with us, including all orders placed, shall not exceed the lesser of: (a) the total amount you paid for the specific order giving rise to the claim, or (b) $500 USD
• This limitation applies per customer, per calendar year, regardless of the number of orders placed
• We are not liable for indirect, incidental, consequential, special, or punitive damages
19. INDEMNIFICATION
You agree to indemnify and hold harmless My Gaea Organics from any claims, damages, or expenses arising from:
• Your breach of these Terms
• Misuse of products
• Violation of law or third-party rights
20. BINDING ARBITRATION & CLASS ACTION WAIVER PLEASE READ CAREFULLY — THIS AFFECTS YOUR LEGAL RIGHTS
Informal Resolution Required (Mandatory First Step)
Before initiating arbitration or any legal proceeding, you agree to first contact us at Info@MyGaeaOrganics.com
and provide a written description of the dispute and the relief requested. We will attempt to resolve the matter informally within thirty (30) days of receiving your notice.
Small Claims Court Priority
Except for intellectual property disputes, any dispute arising out of these Terms or your purchase shall first be resolved in small claims court if the claim qualifies for small claims court jurisdiction.
Either party may bring an individual action in small claims court instead of arbitration, provided the claim meets the applicable jurisdictional limits and requirements.
Arbitration (Only If Small Claims Is Not Available)
If a dispute does not qualify for small claims court jurisdiction, and has not been resolved through informal resolution, then the dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Class Action Waiver
You agree to bring claims only in your individual capacity and waive participation in any class, collective, consolidated, or representative action or proceeding.
Arbitration Location
Arbitration shall take place in Loudoun County, Virginia, or via remote or online proceedings at the arbitrator’s discretion.
Arbitration Costs
Arbitration filing fees, administrative fees, and arbitrator compensation shall be allocated in accordance with the AAA Consumer Arbitration Rules.
Each party shall bear its own attorneys’ fees and costs, except where applicable law or AAA rules require otherwise.
Opt-Out Procedure
You may opt out of this arbitration agreement by sending written notice to Info@MyGaeaOrganics.com
within thirty (30) days of your first purchase. Your notice must include your name, email address, order number, and a clear statement that you wish to opt out of arbitration.
If you opt out, disputes will be resolved in court as specified in Section 26 (Governing Law & Venue).
Severability
If the class action waiver is found unenforceable, this arbitration provision shall be void.
21. AUTHORIZED SALES & RESALE PROHIBITION
Our products are sold exclusively through www.mygaeaorganics.com. Products purchased from other sources are not covered by our policies or guarantees. We cannot verify the authenticity or safety of products sold elsewhere.
You may not purchase our products for commercial resale without written authorization from My Gaea Organics.
No Liability for Unauthorized Products
We disclaim all liability for products purchased from unauthorized sources. Such products may be:
• Counterfeit or tampered with
• Expired or improperly stored
• Diluted or altered
• Mislabeled or repackaged
22. PRODUCT RECALLS & SAFETY ALERTS
In the event of a product recall or safety alert:
• We will notify affected customers via email and website notice
• We will provide instructions for returning or disposing of affected products
• We will issue refunds or replacements as appropriate
Customer Obligation
If you receive a recall notice, you must:
• Stop using the affected product immediately
• Follow return or disposal instructions
• Not resell or give away recalled products

23. EXPORT COMPLIANCE & INTERNATIONAL USE
U.S. Sales Only
Our products are formulated, labeled, and registered for sale within the United States only..
Export Prohibition
You may not export, re-export, or transfer our products outside the United States in violation of U.S. export control laws, including the Export Administration Regulations (EAR) and sanctions administered by OFAC (Office of Foreign Assets Control).
International Purchases
We make no representation that our products comply with the laws, regulations, or labeling requirements of any country outside the United States.
If you purchase products while in the U.S. and transport them internationally for personal use, you do so at your own risk and are responsible for compliance with all applicable customs, import, and regulatory requirements in the destination country.
24. CALIFORNIA PROPOSITION 65

25. LIMITATION PERIOD
Any claim must be filed within one (1) year from the date the issue arose or it will be permanently barred.
26. GOVERNING LAW & VENUE
These Terms are governed by the laws of the Commonwealth of Virginia and applicable federal law, without regard to conflict of law principles.
Any court proceedings (if not subject to arbitration) shall be brought exclusively in the state or federal courts located in Loudoun County, Virginia. You consent to personal jurisdiction and venue in these courts.
Federal Law
Where federal law applies (including FDA regulations, FTC Act, CAN-SPAM, TCPA, ADA, etc.), it shall govern regardless of state law.
27. RIGHT TO REFUSE SERVICE
We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion, including but not limited to situations involving:
• Violation of these Terms
• Abusive, threatening, or harassing behavior toward our staff
• Suspected fraud or illegal activity
• Excessive returns or chargebacks
• Resale activity without authorization
• Any conduct we deem harmful to our business or other customers
This right applies regardless of whether you have placed previous orders or have an existing account.
28. SEVERABILITY
If any provision is found unenforceable, the remaining provisions remain in full force.
29. ENTIRE AGREEMENT
These Terms and incorporated policies constitute the entire agreement between you and My Gaea Organics.
30. CHANGES TO TERMS
We may update these Terms at any time. The "Last Updated" date will be revised. For material changes (affecting returns, pricing, arbitration, or liability), we will notify you via email at least 30 days before changes take effect.
Continued use after changes take effect means you accept the updated Terms. Orders placed before changes will be governed by the Terms in effect at time of purchase.
Material Changes Defined
Material changes include modifications to pricing policies, return/refund rights, arbitration provisions, liability limitations, or any terms that substantially affect your rights or obligations.
